Your pension may sit in the Bank of America UK Retirement Plan, the Bank of America UK Pension Plan, or a legacy arrangement connected to Merrill Lynch, NationsBank or Fleet National Bank UK.

You have the information. Now get advice on what it means for you.

This page can help you understand the key issues. But the right decision depends on your own pensions, investments, tax position, future plans and family circumstances.

Bank of America Merrill Lynch pension review for expats

A Bank of America Merrill Lynch pension review is important because the UK pension position may involve more than one plan, more than one benefit type and more than one corporate legacy.

Scheme research identifies two main plans: the Bank of America UK Retirement Plan, formerly the Bank of America Merrill Lynch UK Pension Plan and renamed in April 2020, and the Bank of America UK Pension Plan. Both main plans are administered by WTW through the Bank of America ePA portal, and both have DB and DC sections.

The research also flags legacy plans connected to NationsBank and Fleet National Bank UK. This matters because the Bank of America and Merrill Lynch pension history reflects multiple corporate eras, including the Merrill Lynch acquisition, earlier Bank of America consolidation and legacy US banking group structures.

For some members, the issue may be a standard DC pension review. For others, it may involve closed DB benefits, insured DB benefits, salary-link features, AVCs or legacy plan records.

This does not mean a transfer is automatically right. In fact, where DB benefits have been covered by annuity policies, the existing scheme may provide a high level of benefit security. A SIPP or International SIPP comparison may still be relevant for DC benefits, consolidation, investment choice or retirement income planning, but it should not be treated as the default answer.

Before making any decision, a former Bank of America Merrill Lynch employee should confirm:

  • Which Bank of America or legacy Merrill Lynch plan holds their benefits.
  • Whether they have DB benefits, DC benefits, AVCs or more than one benefit type.
  • Whether DB benefits are covered by annuity policies.
  • Whether a salary-link feature applies.
  • Whether any legacy NationsBank or Fleet records need to be checked.
  • Whether transfer terms, charges, death benefits and retirement options are suitable.
  • How the pension fits their overseas retirement, tax, currency and beneficiary planning.

Why your Bank of America Merrill Lynch pension may need reviewing

You may have more than one plan

Your benefits may sit in the Bank of America UK Retirement Plan, the Bank of America UK Pension Plan, or a legacy arrangement connected to Merrill Lynch, NationsBank or Fleet National Bank UK.

You may have DB and DC benefits

Both main Bank of America UK pension plans are identified as having DB and DC sections. Some members may need to review more than one type of benefit before making decisions.

Insured DB benefits may be valuable

The research notes that DB sections are covered by annuity policies. That may strengthen the security case for remaining in the scheme, but your own benefit position should still be checked carefully.

Currency still matters abroad

Even where the pension itself is well structured, former Bank of America Merrill Lynch employees living abroad should review sterling pension benefits against future spending currency, tax residency and retirement income needs.

What to check before making decisions about your Bank of America Merrill Lynch pension

1

Which plan are you in?

Confirm whether your benefits sit in the Bank of America UK Retirement Plan, the Bank of America UK Pension Plan, or a legacy Merrill Lynch, NationsBank or Fleet arrangement.

2

Do you have DB benefits, DC benefits or both?

Both main plans are identified as having DB and DC sections. Your review should start by confirming the exact benefit type.

3

Are your DB benefits insured?

The research notes that the DB sections are covered by annuity policies. This may be important for benefit security and should be understood before any transfer discussion.

4

Does a salary link apply?

The research states that some Retirement Plan DB members who were active at closure retained a salary link. If this applies, it may be valuable and should be assessed before any transfer decision.

5

Do you hold AVCs?

Some members may hold AVC balances within the plans. These should be checked separately from the main DB or DC benefits.

6

What does WTW currently show for your benefits?

Both main plans are administered by WTW through the ePA portal. Members should request current statements, plan details and retirement option information.

7

How does the pension fit retirement abroad?

Review the pension against your country of residence, future retirement location, spending currency, tax position, wider assets, beneficiary wishes and income needs.

Reading can help you understand the issues. But it cannot tell you what is right for your pension, retirement plans, investments, tax position or family circumstances.

If you are facing a financial decision, or simply know your current arrangements need reviewing, a conversation is usually more useful than another hour of research.

Why Bank of America Merrill Lynch pensions can be more complicated for expats

Bank of America Merrill Lynch pensions can be more complicated for expats because the pension history reflects several corporate eras.

The research identifies the Bank of America UK Retirement Plan as the main plan, previously known as the Bank of America Merrill Lynch UK Pension Plan before being renamed in April 2020. It also identifies the separate Bank of America UK Pension Plan, plus legacy references to the NationsBank Pension and Life Assurance Plan and the Fleet National Bank UK Pension Plan.

That history matters.

A former employee may think of themselves as a Merrill Lynch employee, a Bank of America employee, a BAML employee, or even a legacy NationsBank or Fleet employee. The pension record may not use the same brand name the member remembers from their employment.

The benefit structure also matters. Both main plans have DB and DC sections. The DB sections are closed to future accrual, and the research states that DB benefits are covered by annuity policies. That can create a stronger security position than many members realise. It may also mean the transfer process or comparison with a SIPP needs to be handled with particular care.

There may also be a salary-link feature for some members. If a member retained a salary link when the DB section closed, that feature should be valued before any transfer or consolidation decision. Losing a salary link could be materially different from moving a standard DC pension pot.

For expats, the wider planning context is also different. A former Bank of America Merrill Lynch professional may now live in the Middle East, Europe, Asia, the US or another jurisdiction. Their pension may still be sterling-based, but their retirement spending, tax position, family circumstances and estate planning may now be cross-border.

A good pension review should therefore be evidence-led:

  • Identify the correct plan and legacy employer history.
  • Confirm whether DB, DC, AVC or salary-linked benefits apply.
  • Understand whether benefits are insured through annuity policies.
  • Review transfer value and retirement options.
  • Check beneficiary nominations and death benefits.
  • Compare existing pension benefits with wider retirement objectives.
  • Consider SIPP or International SIPP options only after the existing plan has been properly understood.

A SIPP or International SIPP may offer broader investment choice, adviser-led oversight, flexible drawdown and consolidation. But for DB members with insured benefits, the existing scheme may provide valuable security that should not be given up without careful analysis and regulated advice where required.

Documents to request for a Bank of America Merrill Lynch pension review

1

Recent benefit statement

Request the latest statement for each Bank of America, Merrill Lynch or legacy pension arrangement you hold.

2

Plan confirmation

Confirm whether your benefits sit in the Bank of America UK Retirement Plan, the Bank of America UK Pension Plan, or a legacy NationsBank or Fleet arrangement.

3

Benefit type confirmation

Ask WTW to confirm whether your benefits are DB, DC, AVC, salary-linked or otherwise safeguarded.

4

Transfer value or CETV

If DB or safeguarded benefits apply, request a current CETV or transfer value quotation and confirm the regulated advice requirements.

5

Annuity policy or insured benefit information

Ask for member communications explaining whether your DB benefits are covered by an annuity policy and what that means for your personal benefits.

6

Salary-link confirmation

If you were active when a DB section closed, ask whether a salary-link feature applies and how it affects your pension.

7

DC fund and charges information

For DC benefits, request current fund values, investment options, annual management charges, transaction costs and any retirement access details.

8

AVC information

If you hold AVCs, request current value, investment fund details, charges, retirement options and whether AVCs can be taken separately or must be coordinated with the main benefit.

9

Retirement options pack

Request details of available retirement options, including scheme pension, lump sum, annuity, transfer, DC access, UFPLS or drawdown options where applicable.

10

Death benefit and beneficiary nomination details

Confirm current expression of wish, nominated beneficiaries, spouse or dependant benefits and any rules that may apply if your beneficiaries live overseas.

11

Letter of Authority

Josh can request a Letter of Authority from you so the Bank of America Merrill Lynch pension scheme or provider can share information with both you and Josh for review and analysis purposes. This does not allow Josh to act on your behalf, transfer your pension, withdraw money, change investments or make any decisions. It is used solely to gather the information needed to analyse the pension properly.

What your Bank of America Merrill Lynch pension review may lead to

Keep the Bank of America pension where it is

This may be appropriate where the existing pension provides insured DB benefits, salary-linked features, suitable DC options, competitive charges or valuable protections.

Compare consolidation options

If you have several old pensions from investment banks or other employers, consolidation may improve visibility, but only after checking whether any benefits could be lost.

Review SIPP or International SIPP options

A SIPP may offer flexibility, investment choice and drawdown access, but it must be compared carefully against your Bank of America Merrill Lynch scheme benefits.

Build a retirement income plan

Your Bank of America Merrill Lynch pension should be reviewed alongside other pensions, investments, cash, tax, currency and future spending needs.

Important information

This page is for general information only.

It does not constitute personalised financial, tax, legal, pension transfer, investment or retirement advice.

Scheme details should always be verified directly with the pension administrator, trustee or official member documentation.

Pension transfers, consolidation, drawdown, tax treatment, safeguarded benefits, defined benefit pensions, salary-linked benefits, insured benefits, AVCs, death benefits and retirement options depend on personal circumstances and may change.

Transferring a pension can be irreversible and may result in the loss of valuable guarantees, protected features or benefits.

Defined benefit and safeguarded benefit transfers require particular care and may require regulated UK pension transfer advice.

For Bank of America Merrill Lynch pension members, particular care may be needed where benefits sit across the Bank of America UK Retirement Plan, the Bank of America UK Pension Plan, legacy Merrill Lynch arrangements, NationsBank or Fleet plans, insured DB benefits, salary-link features, AVCs or multiple plan records.

Investing involves risk. Pension and investment values can fall as well as rise, and you may get back less than you invest.

Review your Bank of America Merrill Lynch pension before making the decision

If you worked for Bank of America Merrill Lynch and now live abroad, your pension may be an important part of your retirement plan. Review it properly before transferring, consolidating or drawing income.
